ABSTRACTThe principle of informed refusal poses a specific problem when it is invoked by a pregnant woman who, in spite of having accepted her pregnancy, refuses the diagnostic and/or therapeutic measures that would ensure the well‐being of her endangered fetus. Guidelines issued by professional bodies in the developed world are conflicting: either they allow autonomy and informed consent to be overruled to the benefit of the fetus, or they recommend the full respect of these principles. A number of medical ethicists (...) advocate the overruling of alleged irrational or unreasonable refusal for the benefit of the fetus. The present essay supports the view of fetal rights to health and to life based on the principle that an ‘accepted’ fetus is a ‘third person’. In developing countries, however, the implementation of the latter principle is likely to be in conflict with a ‘communitarian’ perception of the individual – in this case, the pregnant woman. Within the scope of the limitations to the right to autonomy of J.S. Mill's ‘harm principle’, the South African Patients’ Charter makes provision for informed refusal. The fact that, in practice, it is not implemented illustrates the well‐known difficulty of applying Western bioethical principles in real life in the developing world. (shrink)

The reality factor, however, is that five years later there are still more ‘technically illegal’ abortions than legal ones. Amongst other factors, one of the main obstacles to access to this constitutionally enshrined human right is the right to conscientious objection/refusal. Although the right to conscientious objection is also a basic human right, the case of refusal to provide abortion (...) services on conscientious objection grounds should not be seen as absolute and inalienable, at least in the developing world. In the developed world, where referral to another service provider is for the most part accessible, a conscientious objector to abortion does not really put the abortion seeker’s life at risk. The same cannot be said in developing countries even when abortion is decriminalised. This is because referral procedures are fraught with major obstacles. In this paper I shall define a thesis I shall call ' determinism ', and argue that it is incompatible with the thesis that we are able to act otherwise than we do. Other theses, some of them very different from what I shall call ' determinism ', have at least an equal right to this name, and, therefore, I do not claim to show that every thesis that could be called ' determinism ' without historical impropriety is incompatible with (...) free will. I shall, however, assume without argument that what I call ' determinism ' is legitimately so called. In Part I, I shall explain what I mean by ' determinism '. In Part II, I shall make some remarks about 'can'. In Part III, I shall argue that free will and determinism are incompatible. In Part IV, I shall examine some possible objections to the argument of Part III. I shall not attempt to establish the truth or falsity of determinism, or the existence or nonexistence of free will. The problem of the nature of being was central to ancient and medieval philosophy, and continues to be relevant today. In this collection of thirteen recent essays, Peter van Inwagen applies the techniques of analytical philosophy to a wide variety of problems in ontology and meta-ontology. Topics discussed include the nature of being, the meaning of the existential quantifier, ontological commitment, recent attacks on metaphysics and ontology, the concept of ontological structure, fictional entities, mereological sums, and the ontology of (...) mental states. Van Inwagen adopts a generally 'Quinean' position in meta-ontology, yet reaches ontological conclusions very different from Quine's. The volume includes two previously unpublished essays, one of which is an introductory essay where van Inwagen explains his conception of the relation between the language of 'the ordinary business of life' and that of 'the ontology room'. This article reacts against the undesirable ideological separation between dialectical and rhetorical approaches to argumentative discourse. It argues that a sound evaluation of argumentation requires an analysis that reveals all aspects of the discourse pertinent to critical testing. To explain the rationale of the various moves made in the discourse and the strategic patterns behind them, not only the interlocutors' dialectical goals must be taken into account, but also their rhetorical goals. After explaining how rhetorical insight can be instrumental in (...) deepening and justifying a dialectical analysis, an integrated analysis is made of the rhetorical strategies that are brought to bear in an advertorial published by the oil company Shell. I compare the theory of existence and being (and of non-existence and non-being) presented in Colin McGinn's 'Logical Properties' with those of well known predecessors such as Quine, Frege and Meinong. More recently, neo-Meinongians have held that being and existence are different concepts, and that although nothing lach bang, there are things which do not exist; possibilists have held that there are mere possibilia, things which possibly exist but do not actually exist. I examine a thesis advanced by McGinn which (...) these two positions have also endorsed, namely, that there are things which do not exist. I survey the function of 'existential quantification', and finally contend that the predicate 'does not exist' has at least three meanings, meanings which are determined by the context in which the predicate occurs and which are importantly different from one another. The study of argumentation is prospering. After its brilliant start in Antiquity, highlighted in the classical works of Aristotle, after an alternation of ups and downs during the following millennia, in the post-Renaissance period its gradual decline set in. Revitalization took place only after Toulmin and Perelman published in the same year their landmark works The Uses of Argument and La nouvelle rhétorique. The model of argumentation presented by Toulmin and Perelman’s inventory of argumentation techniques inspired a great many scholars (...) in various ways to take up the study of argumentation in a serious manner. Nowadays there are well-established logical approaches to argumentation, but also social and socio-psychological, linguistic, juridical and other approaches. In most of these approaches traces can be found of the influence of the classical and neo-classical argumentation theories just mentioned. (shrink)

This paper describes a teaching methodology whereby students can gain practical experience of ethical decision-making in the engineering design process. We first argue for the necessity to teach a ‘practical’ understanding of ethical issues in engineering education along with the usual theoretical or hypothetical approaches. We then show how this practical understanding can be achieved by using a collaborative design game, describing how, for example, the concept of responsibility can be explored from this practical basis. We conclude that the use (...) of games in design education can provide an excellent basis for discussing practical and ethical reasoning during the process of design. (shrink)

This article deals with the concept of sentience, and more specifically with the argument from sentience as it is used by utilitarians in the abortion debate and in the advocacy of animal rights. It is argued that sentience is more than feeling pleasure and pain (with empha sis on pain), and that pain is an inborn protection required to fit into the world rather than the substance of evil. S. The network society is generally challenging for today's communication practitioners because they are no longer the sole entities responsible for communication processes. This is a major change for many of them. In this paper, it will be contended that the normative practice model as developed within reformational philosophy is beneficial for clarifying the structure of communication practices. Based on this model, we argue that government communication should not be considered as primarily an activity that focuses on societal legitimation of policy; (...) rather, it focuses on clarifying the meaning of the actions of the government. If the government can convincingly answer the question about the reason for their actions, societal legitimation will subsequently follow. Hence, it is argued that government communication is primarily linguistically qualified. (shrink)

In his classic paper, “The Principle of Alternate Possibilities,” Harry Frankfurt presented counterexamples to the principle named in his title: A person is morally responsible for what he has done only if he could have done otherwise. He went on to argue that the falsity of the Principle of Alternate Possibilities (PAP) implied that the debate between the “compatibilists” and the “incompatibilists” (as regards determinism and the ability to do otherwise) did not have the significance that both parties had attributed (...) to it -- since moral responsibility could exist even if no one was able to do otherwise. I have argued that even if PAP is false, there are other principles that imply that moral responsibility entails the ability to do otherwise, and that these principles are immune to “Frankfurt-style” counterexamples. Frankfurt has attempted to show that my arguments for this conclusion fail. This paper is a rejoinder to that reply; I argue that he has failed to show this. (shrink)

Largely, the concept of energy or vital force, as first analysed by Placide Tempels in Bantu Philosophy, permeates most African ontology systems, worldviews and life views. The Ntomba Chief is chosen because of his above average vital force. This puts him in the position of intermediary between the Supreme Being, the ancestors, and his subordinates. The waning of his energy is incompatible with his position because his energy is that of his tribe. When installed, he takes an oath that, when (...) this happens, he has to accept mohilo, the ‘hastening of death’. In the Chief's case, the hastening of death is not intended to relieve his pain, as it would be with other creatures. The Chief's dying a natural death would result in the loss of the entire community's vital force. Therefore, he has to be killed ritually to avoid that risk. That the Chief agrees to be killed – via a form of advanced directive – poses an ethical dilemma for a Western observer. From the Ntomba perspective, however, where the energy is being, and being is energy, it is the only way to preserve and protect the community's raison d’être. (shrink)

I shall call it ‘the meta-ontological question’. I shall call the attempt to answer the meta-ontological question ‘meta-ontology’ and any proposed answer to it ‘a meta-ontology’. Together with the city council elections, the citizens of Antwerp elected on 8 October 2000 nine district councils. This new decentralised political level is primarily initiated to restore the confidence of the citizens in the city government. By analysing the results of the city and the district elections we try to find indications whether citizens feel closer to their new district governments or not. Apparently district elections resulted neither in a higher voter turn-out, nor in less blank votes. Nevertheless, there (...) is a significant correlation of voter turn-out and blank votes with population of the districts. And although the differences between the electoral results of the city elections and the district elections are not huge, a different political landscape comes more or less into existence in the several districts. Quite surprisingly the number of list votes is higher on the district elections than on the city elections, while we would have expected a higher number of preferential votes. Correctingfor incumbents and famous candidates on the lists, our initial expectations hold much better. Generally spoken, we can conclude that the district elections do not give much proof of a closer connection between the citizens and the city government. Nevertheless we find some important differences between the districts. (shrink)
